It is not enough to have legalized assisted suicide, but now the legislature wants to see it freely promoted!
Authors of 282 assert it is necessary to protect lethal doctors from prosecution, but this rings hollow. The previous measure made their actions legal. Our law was modeled after Oregon’s. and they did not have to ‘restate the legality.’!
Assembly Bill 282 obscures existing law, Contrary to existing statute, which rightly considers it a felony to encourage another to commit suicide, this bill seeks to loosen that prohibition in order to enable the rapid expansion and cultural acceptance of physician-assisted suicide under the End of Life Option Act. This allows heirs and others to encourage and promote suicide, without investigation or any fear of repercussion. The language of the bill may even allow for television, radio and other public advertising promoting ‘assisted suicide’ for the ill, and guidance for third-party encouragement and “personal promotion” of intentional medical killing.
Crucially, there is by design no means to determine whether or not “undue influence” or coercion played a role in the administration of the drugs. The would-be plaintiff is unable to allege any wrongdoing or testify in a legal setting on his or her behalf. They are simply dead. This measure is being pushed to the State Assembly Floor.. Understand this about the bill:
1) Life Legal Defense has this in litigation right now… one of the sticking points – that has helped us prevail at lower court… the original EOLA violated procedure and was snuck through during a special session – passing unrelated measures in special session is not a legally appropriate procedure.
But this bill will would pass in regular session.
2) As written, this new measure could legitimize mass marketing of this form of suicide. as long as it is promoting the End of Life Act (EOLA.) . It states that all other suicide promotion, (“Pull that trigger!” “Go ahead and jump, coward”) is OF COURSE still a felony.
But ads like these may well be broadcast once 282 passes:
“Feeling sick -maybe seriously ill? be sure to see your physician . and ask about EOLA'”
Yes, the promotion and encouragement on a mass, societal level to ALL sick people… would be authorized under this measure.
