Life-Related Proposals—California Legislature—2005

SB 147 Runner: This bill would enact the Unborn Child Pain Awareness Act of 2005.  It would require, with an exemption for medical emergency, the abortion practitioner to offer pregnant woman information and counseling on fetal pain. This bill would require the State to develop a related brochure and a waiver form, would allow the revocation or suspension of medical licenses for violation of these provisions, and would authorize civil action for damages and penalties for violation. CPLC Position: Support

SB 116 Dutton: California is one of several states that have enacted “Safe Haven” laws. A mother may within 72 hours of giving birth, safely surrender her child to a hospital or other designated location. The mother may remain anonymous. The law expires in 2006. This bill makes the law permanent. CPLC Position: Support 
Status: Unanimously passed the Senate and is now the Assembly.

AB 103 Cohn: This bill would prohibit school districts from preventing licensed health clinics from dispensing contraceptives on school campuses. This bill would allow Planned Parenthood and other abortion business the right to be on public school campuses. CPLC Position: Oppose

AB 813 Baca: Prohibits ultrasounds and sonograms from educational and other non-medical purposes. CPLC Position: Oppose

AB 1427 Mountjoy: Requires abortion practitioners performing an abortion on a minor to retain sufficient tissue of the aborted baby to permit DNA testing for the purpose of determining paternity and establishing the guilt or innocence of the accused in any criminal action regarding sexual crimes relating to the aborted pregnancy. CPLC Position: Support

AB 21 Levine and SB 644 Ortiz: Limits the conscience clause for pharmacists with protecting them from retaliation. Does not include exemptions for drug-induced abortions. CPLC Position: Oppose 
Status: AB 21 passed the Assembly and is now in the Senate. SB 644 passed the Senate and is now in the Assembly.

SB 1030 Hollingsworth: Existing law provides that no business establishment shall discriminate against any person in this state because of the race, creed, religion, color, national origin, sex, disability, or medical condition of the person. This bill would require that this provision not be used to require a business establishment to provide nonessential services to a member of the public, if to do so would violate one's conscience due to a sincerely held religious belief. CPLC Position: Support
